Please read these Terms of Service carefully before using the website ‘pikd.io’ or any services provided by ArtBrief UG (Haftungsbeschränkt). By accessing or using our services, you agree to these Terms of Service. If you do not agree to these Terms or our Privacy Policy, you may not use the website, app, or any related services.

1. Scope of Application

These Terms and Conditions ("Terms") govern the use of services provided by ArtBrief UG (Haftungsbeschränkt)("ArtBrief," "we," or "us"), trading under the name Pikd.io. By using or accessing our services, you agree to comply with these Terms.

The current version of these Terms is available at www.pikd.io and supersedes all previous versions. Users will be informed of any updates to these Terms via email or dashboard notifications. Continued use of the services after such updates constitutes acceptance of the revised Terms.

2. Services Provided by Pikd.io

Pikd.io offers software and services enabling users to manage, share, and collaborate on image files and galleries. Key features include:

• Uploading and organizing images, including high-resolution and RAW files.
• AI-powered search for quick and efficient file retrieval.
• Sharing galleries via public or password-protected links with optional watermarking and resolution controls.
• Collaborative tools such as commenting, marking, and selection.
• Scalable cloud-based storage tailored to different subscription plans.

ArtBrief reserves the right to update, enhance, or discontinue any features or functionalities at its sole discretion. Modifications to the services shall be governed by these Terms.

3. User Registration and Responsibilities

By registering an account on Pikd.io, you confirm that:

• All registration information provided is accurate, complete, and up-to-date.
• You are at least 18 years old or have parental or legal guardian consent if you are between 14 and 18 years old.
• Your use of the services complies with all applicable laws and regulations.

Upon registration, users must provide a valid email address, create a secure password, and verify their account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Users hosting public-facing galleries must comply with German legal requirements for imprint and privacy policies, where applicable. Failure to comply may result in account suspension or termination.

4. Subscription Plans, Trial, and Payment Terms

Trial Period:

• Pikd.io offers a trial period with limited storage capacity, allowing users to explore the platform’s features before committing to a paid plan.

Subscription Terms:

• Paid subscriptions are available on monthly or annual billing cycles and renew automatically unless canceled prior to the renewal date.
• Users can upgrade their subscription at any time, with additional charges prorated to the remaining billing cycle.

Refund Policy:

• Payments are non-refundable once a subscription has been initiated or renewed. Users are encouraged to fully utilize the trial period to evaluate the platform’s suitability for their needs.

Cancellation Policy:

• Subscriptions may be canceled at any time. Canceled accounts will retain access to paid features until the end of the billing cycle.
• Upon cancellation, files will remain accessible for a grace period of 30 days, after which they will be permanently deleted unless the subscription is renewed.

ArtBrief reserves the right to adjust subscription prices. Users will be notified of price changes at least 30 days in advance. Continued use of the services after this period constitutes acceptance of the new pricing.

5. Content Ownership and Usage

Users retain ownership of all content uploaded to Pikd.io. By using the platform, you grant ArtBrief a non-exclusive, royalty-free license to store, process, and display your content solely to provide the services.

You are prohibited from uploading content that:

• Violates intellectual property or other applicable laws.
• Contains harmful, illegal, or offensive material.
• Includes spam, malware, or misleading information.

ArtBrief reserves the right to remove any content that violates these Terms and may suspend or terminate accounts in breach.

6. Prohibition of Unauthorized Use

The following actions are strictly prohibited:

• Copying, duplicating, or imitating elements of the Pikd.io tool.
• Reproducing specific features, functionalities, or design elements.
• Reverse-engineering, decompiling, or otherwise attempting to extract the source code or protected aspects of the software.

Any violations may result in immediate suspension or termination of the user’s account and legal action in accordance with applicable German laws.

7. Abusive Use and Content Removal

Abusive use of Pikd.io is strictly prohibited. Abuse includes, but is not limited to:

• Publishing or disseminating illegal, defamatory, pornographic, or offensive content.
• Using, duplicating, distributing, or publicly disclosing copyrighted or trademarked material without proper authorization.
• Publishing any other illegal content.

We reserve the right to immediately delete content that is deemed illegal or abusive. In cases of serious violations, such as the dissemination of illegal content, we will report the user to the appropriate legal authorities.

In the event of a breach of these Terms by the user, we reserve the right to:

• Block the user’s access to the service without prior notice.
• Delete the user’s data no later than 14 days after the blockage.

Additionally, we reserve the right to pursue claims for damages arising from such breaches.

8. Data Privacy and Security

• End-to-end encryption and secure backups to safeguard your files and personal information.

9. Liability and Warranties

ArtBrief provides the services on an "as-is" and "as-available" basis. While we strive to ensure uninterrupted and error-free service, we cannot guarantee:

• Continuous availability of the platform.
• Absence of technical issues, bugs, or data loss.

ArtBrief’s liability is limited to damages caused by gross negligence or willful misconduct. For paid subscriptions, liability is capped at the amount paid by the user in the six months preceding the claim. ArtBrief is not liable for indirect, incidental, or consequential damages.

10. Modifications to Terms and Services

ArtBrief reserves the right to modify these Terms or its services to reflect legal, technical, or business changes. Users will be notified of significant changes via email or dashboard notifications at least 30 days before the changes take effect. Continued use of the services after this notice period constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of Hamburg, Germany (Gerichtsstand Hamburg).

12. Final Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement constitutes the entire understanding between you and ArtBrief regarding your use of Pikd.io.
